Last updated: October 14, 2026
1. GENERAL PRINCIPLES
These General Terms and Conditions of Sale (hereinafter "Terms") govern sales exclusively between Maryline Dupuy, trading as Marylou Rose (hereinafter "Marylou Rose"), and any natural person of legal age with the capacity to contract, not acting in the course of a professional activity, who intends to make or makes a purchase from the online shop www.marylourose.com (hereinafter the "Customer"). Marylou Rose, operator of the online shop, is based in Germany at Jahnstraße 84, 40215 Düsseldorf.
Your statutory rights as a Customer are not affected by these Terms.
These Terms are available on the website www.marylourose.com (hereinafter the "Site") under "Terms and Conditions". As these Terms may change, the version in force on the Site at the time you place your order applies.
Throughout the Site, "we", "us" and "our" refer to Marylou Rose, while "you" and "your" refer to the Customer.
Our shop is hosted by Shopify Inc., which provides the e-commerce platform that enables us to sell our products and services to you.
Marylou Rose wants to offer you the best possible shopping experience. By accessing any part of the Site, whether as a Customer, visitor, supplier, merchant or content provider, you agree not to: (i) post, transmit, upload or promote any content that may harm our business, our team or our products, including libel, defamation, harassment and discrimination; (ii) use our products for any illegal or unauthorised purpose or violate the laws of your jurisdiction, including copyright laws; (iii) infringe our intellectual property rights; (iv) compromise the security of the Site by transmitting viruses, worms, code or any other destructive device, or prevent other users from enjoying the Site; (v) reproduce, duplicate or copy the content of the Site.
We reserve the right to block access to the Site and close the account of any Customer who breaches these or any other provisions of these Terms.
2. ACCURACY AND COMPLETENESS OF INFORMATION ON THE SITE
We take the utmost care in publishing and updating information on the Site. Subject to Article 5c, we cannot be held responsible for (i) changes or modifications to the content, (ii) minor variations or typographical errors, or (iii) suspension or interruption of the service.
We reserve the right to modify the content of the Site at any time. The Site may contain historical data that is no longer current and is provided for reference only.
We may occasionally interrupt the Site, in particular for updates, or discontinue it at any time for legitimate reasons.
We cannot guarantee that the colours of images and texts in the shop will be displayed accurately on your screen.
Marylou Rose sells handmade hair accessories produced in small quantities. Stock levels shown on the Site are for information only. We reserve the right to correct any errors regarding availability and will fulfil orders while stocks last. If an ordered product is unavailable, we will inform you by email. You may then either cancel the entire order or confirm the remainder of the order. Any payment already made for unavailable products will be refunded no later than fourteen (14) days after the cancellation.
3. ORDERING AND CONCLUSION OF THE CONTRACT
Orders can only be placed on the Site www.marylourose.com and are reserved for private individuals of legal age. Professionals can contact us via the form in the "B2B" section of our Site to discuss a potential collaboration.
Items ordered may not be resold for professional purposes.
Click "Add to cart" on a product page to add the item to your cart. You can view and update your cart at any time via the cart icon at the top of the Site (change quantities, remove items, etc.).
Click "Check out" to go to a form where you enter your details and choose your payment method. If you have a customer account, you can use your saved details.
The presentation of products on the Site does not constitute a legally binding offer. By clicking the "Pay now" button, you place a binding order. The contract is concluded when you receive our order confirmation email. By placing your order, you accept the prices, descriptions and these Terms.
Before placing your order, you can review and correct your entries at any time by returning to the previous steps or editing your cart.
We store the text of the contract. You will receive your order details by email and can view and print these Terms on the Site at any time. If you have a customer account, your orders can also be viewed there. The contract can be concluded in English, French or German.
If, for any reason, we are unable to fulfil your order, we will inform you as soon as possible and refund any payment already made no later than fourteen (14) days.
Marylou Rose reserves the right to refuse an order, in particular in the event of (i) a previous or ongoing dispute with the Customer, (ii) total or partial non-payment of a previous order, (iii) an irregularity, or (iv) a breach of these Terms. This may apply to orders placed via the same customer account, the same credit card and/or the same billing or shipping address. In all cases, the Customer will be informed by email.
4. CUSTOMER ACCOUNT
To create a customer account, you must accurately complete a registration form, including the mandatory fields (valid email address and personal, confidential password). The form is accessible via the "Account" section of the Site.
You agree to provide current, complete and accurate information and to update it promptly when necessary, in particular your email address and payment details, so that we can process your orders and contact you if needed.
You may not use a false email address, impersonate another person or mislead us about your identity.
5. PRODUCTS, PRICES AND LIABILITY
5a. PRODUCTS
Products remain the property of Marylou Rose until full payment has been received.
Product quantities are limited. All products come with a description (name, characteristics, composition, etc.), images and a price, which may be changed at any time. Minor variations are possible, in particular regarding colours, which may vary from one screen to another.
Please follow the product description and any instructions for use.
5b. PRICES
Products are invoiced at the prices in force at the time the order is placed. In accordance with § 19 UStG (German small business regulation), no VAT is charged.
We reserve the right to change our prices at any time. Price changes do not apply to orders already completed.
5c. LIABILITY
Marylou Rose is liable without limitation for intent and gross negligence, for injury to life, body or health, and under the German Product Liability Act (Produkthaftungsgesetz).
In cases of slight negligence, Marylou Rose is liable only for breach of an essential contractual obligation, i.e. an obligation whose fulfilment is essential for the proper performance of the contract and on whose fulfilment the Customer may regularly rely. In this case, liability is limited to the foreseeable damage typical for this type of contract.
Limitations of liability in other provisions of these Terms apply only subject to the above.
6. RIGHT OF WITHDRAWAL
You have the right to withdraw from this contract within fourteen (14) days without giving any reason. The withdrawal period expires fourteen (14) days after the day on which you, or a third party other than the carrier designated by you, take physical possession of the goods.
To exercise your right of withdrawal, you must inform us (Marylou Rose, Maryline Dupuy, Jahnstraße 84, 40215 Düsseldorf, Germany, email: hello@marylourose.com) of your decision by an unequivocal statement (e.g. by email). If possible, please include your contact details, the items concerned and your order number and date. You may use the model withdrawal form in our Returns Policy, but this is not mandatory.
To meet the withdrawal deadline, it is sufficient for you to send your communication concerning the exercise of the right of withdrawal before the withdrawal period has expired.
Effects of withdrawal
If you withdraw from this contract, we shall reimburse all payments received from you, including the costs of delivery (with the exception of the supplementary costs resulting from your choice of a type of delivery other than the least expensive standard delivery offered by us), without undue delay and in any event not later than fourteen (14) days from the day on which we are informed of your decision to withdraw. We will carry out such reimbursement using the same means of payment as you used for the initial transaction, unless you have expressly agreed otherwise; in any event, you will not incur any fees as a result of such reimbursement. We may withhold reimbursement until we have received the goods back or you have supplied evidence of having sent back the goods, whichever is the earliest.
You shall send back the goods without undue delay and in any event not later than fourteen (14) days from the day on which you communicate your withdrawal from this contract to us. The deadline is met if you send back the goods before the period of fourteen (14) days has expired. You will bear the direct cost of returning the goods.
You are only liable for any diminished value of the goods resulting from handling other than what is necessary to establish the nature, characteristics and functioning of the goods. We would be grateful if you could return items in their original packaging, with tags and accessories, where possible.
Exclusion: In accordance with § 312g (2) no. 1 of the German Civil Code (BGB), the right of withdrawal does not apply to goods made to the Customer's specifications or clearly personalised, such as items in the "Made-to-measure" section. Gift cards may only be withdrawn within 14 days of purchase and provided they have not been used; after this period or once used, even partially, they can neither be returned nor refunded. For more information, please see our Returns Policy.
7. PRODUCT CONFORMITY AND WARRANTY
The statutory warranty rights under German law apply.
Please check your parcel on receipt and let us know as soon as possible of any obvious defects or deviations from your order by email at hello@marylourose.com. This helps us deal with your request quickly but does not affect your statutory warranty rights.
In the case of defective or incorrect delivery, we will bear the return costs. A product damaged by the Customer, including when opening the parcel, is not considered defective.
8. EXCHANGES AND REFUNDS
When exercising the right of withdrawal under Article 6, exchanges cannot be made online on the Site. You may, however, return items for a refund in accordance with our Returns Policy. Refunds are made without undue delay and no later than fourteen (14) days from the day on which we are informed of your decision to withdraw. We may withhold the refund until we have received the goods back or you have provided proof of return, whichever is earlier. Refunds are made using the same payment method as the original purchase, unless expressly agreed otherwise.
9. THIRD-PARTY TOOLS AND LINKS
The Site may provide access to third-party tools and/or websites that we do not monitor or control. Subject to Article 5c, we are not responsible for any consequences arising from your use of these tools or websites. It is your responsibility to review their terms and conditions. We do not guarantee the content, products or services of third parties.
10. COMMENTS, FEEDBACK AND OTHER SUBMISSIONS
If, without a request from us, you send us creative ideas, suggestions, proposals, plans or other materials, whether online, by email, by post or otherwise (collectively, "comments"), you grant us the unrestricted right to edit, copy, publish, distribute, translate and use them in any medium at any time. We are under no obligation (i) to keep any comments confidential, (ii) to pay compensation for any comments, or (iii) to respond to any comments.
We may, but are not obliged to, remove content and accounts that we determine to be unlawful, offensive, threatening, defamatory, pornographic, obscene or otherwise objectionable, or that infringe third-party rights or these Terms.
Your comments must not infringe the rights of third parties, including copyright, trademark, privacy or personality rights, and must not contain unlawful, abusive or obscene material, viruses or malware. You may not use a false email address, impersonate another person or mislead us or third parties about the origin of any comments. You are solely responsible for your comments and their accuracy.
11. PERSONAL INFORMATION
The processing of your personal information is governed by our Privacy Policy, available here.
12. CONTACT
For any questions about these Terms, please write to us at hello@marylourose.com. We will be happy to reply as quickly as possible (within 2 to 7 working days).
13. INTELLECTUAL PROPERTY
All texts, comments, works, illustrations and images on the Site are protected by copyright, trademark law and image rights, for all media and worldwide. They are the exclusive property of Marylou Rose.
They may only be used for private, non-commercial purposes. Any other use without prior authorisation constitutes an infringement. Any total or partial reproduction of the Site's catalogue is strictly prohibited.
14. APPLICABLE LAW
These Terms are governed by German law. If the Customer is a consumer habitually resident in another member state of the European Union, this choice of law does not deprive them of the protection afforded by the mandatory provisions of the law of that state.
If any provision of these Terms is or becomes invalid, the validity of the remaining provisions shall not be affected.
